Terms of Service

Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you and Sakaloz ("we", "our", or "us") governing your access to and use of the Sakaloz mobile application, website at sakaloz.com, and all related services (collectively, the "Service").

By creating an account, downloading the app, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

Plain language summary: By using Sakaloz, you agree to follow these rules. If you disagree with any part, please do not use the app.

Eligibility

To use the Sakaloz Service, you must meet all of the following requirements:

  • You are at least 16 years of age or older.
  • You are currently enrolled as a student at a recognised educational institution (university, polytechnic, or equivalent) in Portugal or another EU member state.
  • You have the legal capacity to enter into binding agreements.
  • You are not prohibited from using the Service under the laws of Portugal or any other applicable jurisdiction.

Sakaloz reserves the right to verify your eligibility at any time and to suspend or terminate accounts that do not meet these requirements.

Your Account

Registration

To access the full Service you must register an account by providing accurate, complete, and current information including your name and email address. You agree to keep this information up to date.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

  • Choose a strong, unique password and not share it with anyone.
  • Notify us immediately at sakaloz.hello@gmail.com if you suspect any unauthorised access to your account.
  • Not allow any other person to use your account or QR code.

One Account Per Person

Each person may only hold one Sakaloz account. Creating multiple accounts to circumvent verification, suspensions, or subscription requirements is strictly prohibited and will result in permanent termination of all associated accounts.

Account Deletion

You may delete your account at any time from within the app. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Certain records may be retained where required by law (e.g. payment records for tax purposes).

Billing & Auto-Renewal

Paid subscriptions renew automatically at the end of each billing period. You authorise Sakaloz to charge your payment method on file through Stripe on each renewal date unless you cancel beforehand.

Cancellation

You may cancel your subscription at any time through the app. Cancellation takes effect at the end of your current billing period — you will retain access until that date. We do not offer pro-rata refunds for partial billing periods, except where required by applicable consumer protection law.

Refunds

All subscription fees are non-refundable except where:

  • You are entitled to a refund under mandatory EU or Portuguese consumer law (Decreto-Lei n.º 24/2014).
  • Sakaloz has materially failed to provide the Service for a significant portion of your billing period.
  • A refund is expressly granted at our sole discretion as a goodwill gesture.

To request a refund, contact us at sakaloz.hello@gmail.com within 14 days of the charge.

Price Changes

We reserve the right to change subscription prices. We will give you at least 30 days' notice before any price change takes effect. Your continued use of the Service after a price change constitutes acceptance of the new pricing.

Payment processing is handled exclusively by Stripe. Sakaloz does not store or have access to your full card details. By subscribing, you also agree to Stripe's terms at stripe.com/legal.

Student Verification

To unlock discount redemption, you must complete student verification by uploading a valid student ID or proof of enrolment. By submitting verification documents, you confirm that:

  • The document is authentic, current, and belongs to you.
  • You are currently enrolled as a student at the institution shown.
  • You have not altered, forged, or manipulated the document in any way.

Sakaloz reviews verification submissions manually. We aim to process requests within 24–48 hours on business days. Verification decisions are at our sole discretion.

Fraudulent verification — submitting false, forged, or borrowed documents — is a serious violation of these Terms and may result in immediate account termination, forfeiture of any subscription fees paid, and referral to relevant authorities where appropriate.

Discounts & QR Codes

Upon subscribing and completing verification, you receive access to generate personal QR codes to redeem discounts at partner businesses. The following rules apply:

  • QR codes are personal and non-transferable — they may only be used by the verified account holder.
  • Each QR code is single-use and expires after redemption.
  • You must present the QR code in person at the business location.
  • Discounts are subject to each business's own terms, opening hours, and availability — Sakaloz does not guarantee that every offer will be available at all times.
  • Sharing, selling, or otherwise transferring your QR code or account access to another person is strictly prohibited.

Attempting to generate or use QR codes in an unauthorised manner, or using technical means to replicate or forge QR codes, will result in immediate account termination and may be subject to legal action.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorised access to any part of the Service, our servers, or any connected systems.
  • Use automated tools, bots, scrapers, or scripts to access or interact with the Service.
  • Reverse-engineer, decompile, or attempt to extract the source code of the app.
  • Submit false, misleading, or fraudulent information, including during student verification.
  • Harass, abuse, or harm other users, business partners, or Sakaloz staff.
  • Upload or transmit malicious software, viruses, or harmful content.
  • Use the Service in any way that could damage, overload, or impair its functionality.
  • Sell, rent, or commercially exploit your account or the discounts you receive.

Violation of these acceptable use standards may result in immediate suspension or permanent termination of your account without refund.

Business Partners

Partner businesses ("Visors") on the Sakaloz platform operate independently and are solely responsible for the goods and services they offer. Sakaloz acts as an intermediary platform and:

  • Does not guarantee the quality, safety, or availability of any products or services offered by partners.
  • Is not party to any transaction between you and a partner business.
  • Is not responsible for any dispute, complaint, or claim arising from your interaction with a partner business.

If you have a complaint about a partner business, please contact us at sakaloz.hello@gmail.com and we will do our best to help. For direct complaints about goods or services, you should contact the business itself.

Sakaloz reserves the right to add, remove, or modify partner businesses and their offers at any time without notice.

Intellectual Property

All content, software, branding, logos, text, graphics, and design elements of the Sakaloz Service are the exclusive property of Sakaloz or its licensors and are protected under Portuguese and international intellectual property law.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended personal, non-commercial purpose. This licence does not include the right to:

  • Copy, reproduce, or distribute any content from the Service.
  • Use the Sakaloz name, logo, or branding without prior written permission.
  • Create derivative works based on the Service or its content.
  • Sublicense or commercially exploit any part of the Service.

Any content you submit to Sakaloz (such as profile photos or reviews) remains your property. By submitting it, you grant Sakaloz a non-exclusive, royalty-free licence to use, display, and reproduce that content solely for operating the Service.

Termination

Termination by You

You may stop using the Service and delete your account at any time through the app. Cancelling a paid subscription before the end of your billing period does not entitle you to a refund for the remaining period, unless required by law.

Termination by Sakaloz

We reserve the right to suspend or permanently terminate your account, with or without notice, if we have reason to believe that you have:

  • Violated any provision of these Terms.
  • Provided false or fraudulent information.
  • Engaged in activity that harms Sakaloz, other users, or partner businesses.
  • Ceased to meet the eligibility requirements.

In cases of serious violation (fraud, illegal activity), we may terminate immediately without prior notice and without any obligation to refund. In less serious cases, we will generally provide a warning before taking action.

Effect of Termination

Upon termination, your right to use the Service ceases immediately. Any active subscription will not be refunded unless required by law. Data deletion will proceed in accordance with our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" without warranties of any kind, either express or implied.
  • Sakaloz does not warrant that the Service will be uninterrupted, error-free, or completely secure.
  • Sakaloz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
  • Our total liability to you for any claim arising from or related to the Service shall not exceed the total amount you paid to Sakaloz in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under mandatory Portuguese or EU consumer protection law.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email at least 14 days before the changes take effect, and update the "Last updated" date at the top of this page.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account before the effective date.

Governing Law & Disputes

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

Any disputes shall first be attempted to be resolved amicably by contacting us at sakaloz.hello@gmail.com. If a resolution cannot be reached within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.

As a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.
